General Terms and Conditions – for buyers and bidders

For auctions organized and held by Szuhai Horses.

The auction is organised by HORSES FOR SALE KFT. (Company Registration Number: 01 09 297777, Adószám: 25944990241)

1 Participation in this auction is accompanied by the express and unconditional knowledge and acceptance of these auction conditions.

2 The buyer must register on the website Szuhai Horses before being able to participate in the auction.

3 The horses / foals will be auctioned in the state in which they are at the time of the auction.

4 The sale is made in accordance with Hungarian law by acceptance of the offer by the seller and after payment of the invoice amount.

5 Bids and payments are in Euro. Hungarian bidders can arrange the payment in Hungarian Forint as well. In this case the amount is calculated based on the middle exchange rate of the Hungarian Central Bank.

6 When you submit an offer, you are required to pay the purchase price of the horse / foal in the event that you are the highest bidder. It is not possible to withdraw a bid.
When placing a bid, the bidder is deemed to bid for himself and is personally liable for the obligations arising from his bid. If the bidder declares that he is acting on behalf of a third party, he/she shall remain fully liable for the obligations arising from that bid towards Szuhai Horses in addition to this third party.

7 An offer accepted by the seller for a horse / foal leads to a binding agreement under which the buyer is obliged to complete the transaction. By submitting an offer, the bidder agrees to pay the invoice amount.
The billing for the buyer is as follows: the selling price + VAT (if applicable) + 8% commission + (VAT of the commission) = Invoice Amount

8 The invoice amount is due immediately upon award of the bid. Once the seller has accepted the offer, the buyer will receive an e-mail stating the invoice amount and the payment details.

9 Any liability for the auctioned horse / foal shall pass to the buyer 5 days after award of the bid.

10 The horse / foal as property passes (to the buyer) at the time of payment of the invoice amount by the buyer. The transfer takes place only when the entire invoice amount has been transferred to the account of the seller.

11 Neither the seller nor the buyer can derive a claim from the fact that the horses / foals were examined by a veterinarian on request.

12 After paying the price of the horse, the Buyer receives the veterinary documentation, video and photos of the horse.

13 In the event a dispute arises between the Buyer and Szuhai Horses, Parties will attempt to find an amicable solution. If any of Parties believes that no solution was reached, the Court of Eger is exclusively competent.

14 This Agreement shall be governed by the laws of Hungary.
